Refusal to Accept e-Military Record - Why This Decision by the TCC Is Illegal.

The electronic military record has the same validity as the paper one. Therefore, the territorial recruitment center cannot refuse to accept this document when processing a deferment.

Why the TCC Cannot Ignore the Electronic Military Record

A citizen approached lawyers with the question of whether a territorial recruitment center could refuse to grant a deferment by not considering the electronic military record.

'Refusal to accept the electronic military record is illegal,' emphasized lawyer Vladislav Deriy in his response.

He noted that according to paragraph 58 of the CMU Resolution 560, the military liable must present a military record (in the form of an electronic document) when submitting an application. The application from the military liable must be registered on the day of submission.

Also, according to paragraph 9 of the CMU Resolution 559, electronic and paper military records have equal legal force.

How to Submit e-Military Record and Challenge TCC's Refusal

'Submit a printed e-Military Record from 'Reserve+' or 'Diia',' advises Deriy.

If a citizen is still refused, there are two options for further action:

• undergo a military medical commission, choosing the direction through 'Reserve+';
• challenge the inaction of the TCC in court.
